can i change my sons latr name to my husbands without him adopting him. My sons biological father hasn't seen him since he was 4 months old and my son is almost 6. he does pay childsupport but only because the courts make him

You can file a Petition asking the Court to approve a name change for your child. The child's father will be given an opportunity to object, but if he does not, and if there are no other reasons to deny your Petition, the Judge might very well approve your Petition.
