Child Abuse and Neglect!

My uncle has a daughter and he has never been married to the mother. He has never had legal custudy of his daughter she is now eight years old. She was resently taken away from her mother by the Department of family services. I believe that she has been a victum of child abuse and neglect. I am afraid that the mother will regain custudy of this girl again. She is severly underweight and has a number of medical problems. What can we do to ensure this childs saftey. Her life is at sake please help.

Two suggestions come to mind in response to your question. First, if your uncle is interested in his daughter's well being, then he could file a lawsuit seeking a Determination of Paternity and asking the Court to place legal and physical custody of the child with him. If he is not interested in doing this, and if you are related to the child and willing to take responsibility, you may file a lawsuit seeking a Declaration of Guardianship which would name you as the legal guardian of the child and place legal and physical custody with you. If there is already a pending case in the Juvenile Court (Family Court), you may be able to intervene in that case and request that the child be placed with you rather than in foster care.
