Legal Question in Family Law in Missouri

Child Custody

My husband and his ex wife have joint custody of their children but she has physical custody. The children at the moment are living with my husbands mother because basically their mom doesn't want to deal with them... she gives excuses like she doesn't have gas to drive.. the other day their moms electricity was shut off also... She is from peru and is saying that she is going to take them there this summer.. in the divorce decree it states that she is not to leave the state with out his permisson.. He has told her that he doesn't want them going but she just ends the phone call... their passports have expired so she would have to get new ones and also we are affraid that she wont come back or will try to get rid of the kids when she is down there.... she lives in kansas and we currently live in florida but are moving to missouri to be closer to them ...we want full custody is there anything that we can do?

Yes, your husband could file a Motion to Modify in the Court where the dissolution was granted. You did not say where the dissolution took place. If it was in the eastern part of Missouri I might be able to help. If not, your husband should hire a local lawyer where the dissolution was granted.
