Child Custody

If you're married with a child and the father leaves who has custody of the child( child is in mother's custody now)?

Under the circumstances you describe, each parent has an equal right to physical custody of the child. In a practical sense the mother has physical custody since the child resides with her. However, if the father chose to have the child reside with him then the father would have physical custody. In neither case is there any Court Order in effect placing legal custody of the child with either parent, and of course that means that there is no Order in effect regarding child support either.
