child custody

mother of my son who is 9, lives in Chicago, Il, has physical custody, I have visitation. She just divorced her current husband, and is now seeing a 56 yr old man, She has relocated 3 times in last 4 yrs, from St.Louis to Calif, back to St.louis, now in Chicago, supposedl all so she could stay in her degree field. My sons grades are slipping, and I wanted to know if I have a chance to get custody? I have been in St. Louis, last 3 yr with same job, and can get apt here for us. I have a 700 credit score. What percent of a chance dp I have in requesting custody. My son said he would like to live in St. Louis. He is in gifted program, but he is suffering with the chaos in his life. I'm wooried about a 56 yr old enough to be his grandfather who divorced his wife, and has dated the mother while she is married. He could be a pedophile. Please advise.

You did not tell us how the mother has custody and you have visitation. Is there a Court Order? Where was it rendered? The answer to this question will determine where you would need to take legal action in an attempt to gain custody of your son.
