Child Custody

I am thinking of moving from my present residence to another state about 9 hundred miles away. My ex boyfriend states that he will not allow my son to move with me even though we have never been to court or ever had a official child custody agreement or parent plan court ordered. My son has lived with me all his life, I have provided all the medical insurance, taken him to all his doctors appts, attended all his parent teacher conferences and my ex has never attended one. My ex-boyfriend is a trucker who lives in a motel every other weekend so that he can see his son, but has no permanent residence, no vehicle to provide transportation to my son. Also he has no medical insurance on my son. Does my ex-boyfiend have any legal right to make this statement,( that my son cannot move with me). Thank you.

Is your "ex boyfriend" the legal father of the child? If not, then he has no say. If so, then you should comply with the terms of the relocation statute, by providing him with the specific notice required by law. He would then have the right to file a Motion in Court asking the Court to determine whether you may take the child out of state, and if so, on what conditions.
