child support when 2 children are seperated

I have 2 children. My son will be moving in with me as agreed to by my ex-spouse. My daughter will still be living with ex-spouse. How would the child support work in this case with one child living with each parent?

In my twenty-four years of practice I have seen numerous situations such as yours. I can not overemphasize how importantit is for you to obtain the legal services of a competent attorney immediately. You must seek a Modification of the original Decree of Dissolution (Court Order)to be sure the actual change in custody arrangements and child support are approved by the Court. In many cases like yours the father fails to take care of the legal necessities with the result that the original Order for child support remains in effect even though the situation has changed. To answer your basic question, on a Motion to Modify the original Court Order, the court would probably change Custody of the one child to you from your ex-wife. Then child support would be calculated using Form 14 with you as the custodial parent for one child and your ex-wife as the custodial parent for the other child. Depending upon your relative incomes and other pertinent factors one or the other of you may still have to make a reduced child support payment. If all of the factors are equal, there may be no actual child support payments made by either parent to the other.
