Legal Question in Family Law in Missouri

Child support & disability

I am a divorced parent, and pay child support. I recently had to have back surgery and was out of work for 4 months. at that time I had no income, due to not having disability insurance. I was therefor unable to pay child support for 3 months. Am i obligated to pay support when i had no income due to being physically & medically unable to work?

Re: Child support & disability

If your child support order was entered by a Missouri Court, then you were under said order during the time of your disability. Unfortunately, you would have needed to file a Motion with the Court to obtain some relief at the time of your disability or shortly thereafter to get some court ordered relief. It may not be too late to file a Motion to lower your child support obligation which would make it easier to catch up, but you would need to pay the attorney's fees and court costs. If this would make practical sense for you, you should hire an attorney.

Yes, you are obligated to pay. If you run into hard times, you must file a motion and ask the court to suspend or modify the support order. But that normally should be done before one starts going into arrears due to such a hardship, if you know that it is coming up.
