Legal Question in Family Law in Missouri
child support
You said that I might could file petition for paternity,But read where you said that if a parent signed the birth certificate that was proof.Me and my ex have been divorced for 9yrs and I have paid faithfully, but she told me daughter that I wasn't her dad, there has always been doubt but I didn't pursue it at the divorce to keep from hurting anyone but now she want me to continue to pay support. Her real dad doesn't have any money.Could I file a petition for paternity? And If I'm not her dad what about all the years I paid medical and support. How much do you think this could cost(ballpark)Can I suspend any support payment until conculsion of the test? What is the possibilty that a judge would file a petition.

Re: child support
These follow up questions should be discussed either in person or by telephone with an attorney.
Until you are able to do so, you are legally obligated to continue paying child support and whatever else the Judgment requires. Most attorneys will insist upon receiving a retainer fee up front in order to take on a case such as yours. That retainer fee may vary from attorney to attorney, but should be in the $2500 to $5000 range. The attorney will bill against that retainer fee at his or her hourly rate, and the entire case may cost more of less thatn the initial retainer fee by the time the case if frinished. In addition to the attorney's fees you will need to pay the filing fee and costs for any lawsuit. You may call me for a consultation if you do not already have an attorney.
