child support

My girlfriend was arrested and charged with non-support. Eight of the 12 months she was charged with non-support was while she was in prison. Since she was arrested, her ex-husband has sent a notorized letter to child support enforcement (in Missouri) and told them that he wants to have the arrearage dropped and the slate wiped clean. My question is in view of this, does the state still have a case against her?

The answer to yoru question is yes. A person's child support obligations do not disappear just because that person goes to prison. People in prison can hire an attorney to obtain a modification of the pre-existing Order for child support. Still, this person should hire an attorney to defend the current charges.
