Legal Question in Family Law in Missouri

Child Support

The judge gave me custody of my daughter and made her mom pay me child support. It's not much, but she still hasn't paid me in over two years but I still let her see my daughter at regular times. Is there something I can do or will she get in trouble from the state?

Re: Child Support

It is good that you continue to follow the court order by allowing your ex to have her "parenting time' with the child or children. Your ex's failure to pay the court ordered child support does not effect her rights to see the child or children. If I were you I would consult with an attorney about filing a Motion for Contempt against your ex concerning the child support. This is a legal process which will drag your ex back into court and bring her faiure to pay child support to the judge's attention. In many cases, it results in some child support being paid. Or, you may consider opening a file with the Division of Family Serivces (formerly known as the Division of Child Support Enforcement) and requesting them to take collection actions against your ex. If you would like to discuss this further you may call me for a consultation.
