Legal Question in Family Law in Missouri
Child Support - Mom being deployed
My son lives with his bio-mom in Missouri. We have a child support case through FL Dept of Revenue and the check is sent to her in MO.
Bio-mom is in Army and being deployed in December to Iraq for 12-18 months (minimum). Son will be coming to live with me while she is gone.
If she provides me with a copy of the Family Care Plan (which gives me custody of our son while she is deployed), can I request to suspend the child support payments? I cannot afford to support my son and send the support to his mother at the same time.
We only have a support order on file with the clerk, and no legal visitation papers.

You will need to modify the Missouri court order unless Bio Mom agrees in writing and courts are notified and agree.

You will need a written agreement with her and get written approval from the Missouri court. I suggest consulting with an attorney before going to court.
