Legal Question in Family Law in Missouri

Child Support payment

I am currently paying child support, I have a daughter who is graduating from junior college this May. She is continuing her education in St. Louis, away from home. Am I required to continue paying child support? She will be renting an apartment with a friend in the St. Louis area while attending college, does this qualify her as emancipated?

Thanks

Re: Child Support payment

The statute governing child support changes often, so it is a good idea to stay up to date on it and on your continuing obligations. Usually, in cases where the child continues on with post secondary education the obligation to pay child support continues either until graduation or the child reaches the age of twenty-two years whichever comes first. There are various other more detailed requirements however, such as the requirement for the child to carry a full academic load and to continue to make her grades (progress towards graduation), and the requirement that the child or the custodial parent provide the payor of child support with copies of the child's schedule or transcripts on a regular basis. I would suggest that you arrange a consultation with an attorney. I believe that knowing your rights and obligations is worth a modest attorney's fee for the time and effort it takes an attorney to provide you with competent, up to the minute advice which is applicable to your own particular situation.
