Child Support ruling

Divorced in 1988. Court order for spouse to place $300.00 annually for children's education fun. Monies left in account after age of 21 were to be disbursed to said child. Child did not receive any monies for College or on 21st birthday.

Rationale of former husband is that the monies in excess of $36,000.00 plus interest are reverted back to him since child did not ask at that time and did not enroll at that time.

Is my son (now age 24) entitled to any of these funds?
