More Child support!
I have a son that will be 17 in February. My ex wife has never taken me back to court for child support increase so I have become comfortable with current payment. I have paid her direct for the past seven years and she filed for cash assistance last year and told the courts that I havent paid her for all that time. I provided all but the oldest two years records that I could not get from the bank. Now the payment center is taking money back from her to pay for what she said she never received. This has made her mad not mentioning the fact that 18 is around the corner, she is attempting to get all she can and is asking for almost a $500.00 increase per month. Based on all bills,house payment, truck payment used for work, food, utility bills etc. this amount is just not possible. The child only comes around when it is convenient for him (holidays birthdays) just to get more from me. What are the chances of showing that this amount cannot be meet and or possibly filling for allieniation of effection and having the child emancipated. Thanks,

If there has not been Court ordered support yet, You and your ex are free to agree on an amount. If you two cannot agree, then one will need to go to the Courts to get enforcement of any amount. As to emacipation. Under the facts you provided, there seems no basis for that. As to the child not visiting oftern enough, there is not enough facts in your description to say if anything can be done to amend Court ordered support. I have never heard of a 17 yr old visitning sporadically as abasis fof alienation of affection. However, new causes of action are started each year.
