Child Suppport

My husband (2nd marriage) has a son who is 19 years old and has lived with his mother all his life. He lived with us briefly from March til June of this year due to his mother having been evicted, loss of her job, car, etc. He was going to ILC for high school since he couldn't cut regular school, but has since flunked out of that and says he's going to get his GED. Since June he has been back living w/ his mother in an apt. and she wants my husband to continue to pay child support. My question is, how much in school does he have to be to still get child support and for how long? We've been told by Fam. Ser. that til he's 22 and still going to school, but they didn't say how many hours...and what if he starts getting failing grades there?

I believe that the basic child support statute says that child support is owed until the child reaches 18 unless the child proceeds on to college following graduation from highschool. I do not believe that the statute speaks to those cases in which a child drops out prior to completing high school. I think that your husband should file a Motion seeking to terminate the child support obligation and let the judge decide. Good luck.
