Legal Question in Family Law in Missouri

Children/ Legal Custody

Can I get legal custody of my sister's three kids because she does not take care of them. She has neglected them since the day they were born. One is 6 years old, 3 years old and 3 months old. Me and my parents have been raising these kids since they were born. My sister has a history of drug abuse and so does the father. Netiher one will take care of these kids due to their drug problem. They don't give me or my parent's any money for supporting their kids. I would like to know my options as fair as getting custody and taking all their rights away from them.

Re: Children/ Legal Custody

There is not a good answer to this question with just the information provided. However, you or your parents can file for guardianship in the county where the children are located. You will need to serve the mother and father and allege that they have abandoned, neglected, etc. the children and that you and your parents have been taking care of them and providing for them. The guardianship will not terminate them as being parents but will place the legel custody of the children with whomever the court decides is in the children's best interests. Another route may be to involve DFS but that may be a road you don't want to go. You should consult an attorney who can advise you the various means available to you and what he/she would recommend based on the circumstances of your case. Good luck.
