Legal Question in Family Law in Missouri
One of my children as moved in with me and is now attending a new high school. My other child is in college, but when not in school stays with me as well. I was ordered to pay child support to their mother, and neither child has visited or spent any overnights with their mother for at least the past few weeks. Their mother is also not following through on paying 1/2 of their educational expenses. It doesn't make sense that I'm paying her child support for kids that don't even live with her. Can I have the child support stopped from my wages?

Yes, I believe so. But, you should be sure to take the legal action necessary to change the existing court order as soon as possible. Generally speaking, if the mother has voluntarily relinquished the physical custody of the children to you, then your duty to pay child support should abate after the first thirty days, but this is not automatic. I strongly advise you to consult with an attorney. I have handled many of these situations and you may contact me for a free telephone consultation if you are not already represented.
