Child's eduacation

If my divorce papers say that my ex-husband has to pay 70% of my sons Catholic Education and he decides he doesn't because the child is failing a few classes--can he be forced to pay? My ex is refusing and I have already started paying my share of the tuition.

If you are referring to grade school or high school, AND your decree does not provide that your son must be passing all classes, then your ex-husband is still responsible for the 70% share of the tuition. However, you will have to file a motion asking the court to determine exactly how much (dollar amount) your ex-husband is responsible for, obtain a money judgment, and then enforce the judgment; and/or you can file a motion to have him found in contempt. Before doing either of the above, send him a written request for the amount you believe he owes so you will have a record that he was given notice and still refuses to pay.
