Legal Question in Family Law in Missouri

My child's monther has 9 pending felony warrants and i believe she was on probation and has violated. She currently has my son and is threatening to move out of state. I know she has a fugitive from law warrant and i believe she will possibly do some jail time when caught. Would i be able to get permanent custody of my son if i file for it?
