Legal Question in Family Law in Missouri
college tuition
My divorce decree was modified stating that I was to pay 1/2 of my daughter's college tuition and all associated costs. I lost my job in May 2004 due to corporate downsizing. Without any income other than unemployment benefits, I cannot cover my own mortgage and monthly bills without withdrawing funds from savings. Having still not found permanent employment, how can I get relieved of the college tuition expenses? What happens if I don't pay? One note. I am totally estranged from my dauhjter now for over 7 years. No contact whatsoever.

Re: college tuition
It sounds like you might be able to prevail on a Motion to Modify, especially if the existing Court Order also calls for payment of child support. The fact that you are estranged from your daughter is not really relevant to the court on the issue of whether you can afford to pay what you have been ordered to pay. Of course, you would need to come up with the funds to hire an attorney and pay the filing fee, but it may be well worth it in the end.
