Legal Question in Family Law in Missouri
Court ordered maintenance
My fiance just finished paying back child support from a nasty custody/support battle. As soon as he was finished and the amount was reduced to normal support only, his ex-girlfriend, not ex-wife--they were never married, began calling the support office saying she was owed more money. We went to the office yesterday and apparently there was order that was overlooked for $6000.00 in maintenance. Why would he be ordered to pay maintenance for someone he was never married to and didn't have a lengthy relationship with. He can barely afford to live as it is because the current support is so high, he carries all of the child's medical, dental, and vision insurance and she gets to claim him every year on her taxes. My fiance is considering getting legal coucil, but can orders such as these be taken away? What could the court see as the necessity for the maintenance. I just don't see why he should be struggling to stay afloat while she is living the good life with his money. The child support is not the issue here, it's the maintenance. Does he have a leg to stand on?

Re: Court ordered maintenance
Have you seen a Court Order requiring your fiance to pay anyone "maintenance"? That is the first thing I would insist upon. I would suggest that he needs to hire an attorney to get to the heart of the problem and deal with it. Something is definitely amiss if the facts stated in your question are correct. I do handle this kind of problem, and either you or your fiance may call me at the office for a consultation.
