custdy/emancipation

wife awarded custody of 16 year old daughter.daughter does not want to stay because mom hits her and mentally abuses her.moms had custody for 1 week and has hit her in the face .she said to cops it was discipline.nobody will believe her.mom is bipolar also.daughter needs help.what else can be done.mom said she will fight emancipation.

There are various options available. First, Dad, could file for a change of custody. Second, a third person (grandparent perhaps) could file for a change of custody. Third, the DFS could be called in and possibly place the child isn a safer environment. Fourth the child could be taken to the juvenile court and possibly placed in foster care.

Fifth, Mom could sign over a specific power of attorney to some third person who would care for the daughter for up to one year at a time. There may be others, but these will give you something to think about.
