Legal Question in Family Law in Missouri

custodial parent moved out of state not following procedure in the child support papers, it's been 7 monthes since I've seen my child. I've only been allowed to talk to my child 4 or 5 times in that 7 monthes, what can I do to be able to get my rights as a father and non-custodial parents rights [and I do pay my child support]to see my child again ? The state takes out over half my income and I still don't get to see or talk to my child. The custodial parent decides when i get to talk to child.

Thank You,

James

The fact that you are paying child support has nothing to do legally with your custody rights. From the limited facts you provide, it appears that you woudl be able to file a motion to modify the existing Court Order, have your ex served wherever she is living and then let the court decide how to protect your rights. These are difficult cases and can be expensive. However I have handled quite a few of these in the thirty-three years I have been practicing law. If you do not already have an attorney I would be happy to speak with you. If I can not help you myself, I might be able to help you find an attorney that can help you.
