Custody of child

If there is no custody done by the courts. Could the Father keep the child until going to court? Or would the mother get the child back?

Is the father of the child the legal father of the child? That is, were the parents married when the child was born? Or, is there a Judgment of Paternity? Or, did the father sign an Affidavit of Paternity? If so, then the father has as much right to the custody of the child as the mother, pending furhter court orders. If none of the above are true, then the father is not the legal father fo the child and has no right to custody of he child until there is a court order in place.
