Re: Custody of children in parents death
Generally speaking, most people use a Last Will and Testament to provide for guardians of surviving minor children in the event that both natural parents die before the youngest child reaches the age of majority. Usually the will also sets up a trust and names a trustee to manage the money and pay for the expenses of raising the children with any amounts remaining after the youngest child reaches the age of majority being distributed to the heirs. The guardian and trustee jobs may be performed by the same person or people. In some cases it may be best to name an institutional trustee. The Will spells out exactly what the trustee is empowered to do and exactly how and when the final distribution is to be made.
