Custody

My ex-wife has legal custody of my son and lives in Florida. 2 weeks ago she sent him to her mothers house in North Carolinaand granting her tempory custody after she said she was having marital problems and I offered to take him. Can she legally give this custody to her mother if I am fully capiable and able to care for my son? He is going to be 12 in 1 month.

Where were you divorced? If the divorce was here in Missouri you may be able to file a Motion to Modify and obtain a Court Order placing custody of the child with you. Or, if the divorce was in Florida, you might be able to do the same thing in Florida. Your post only states that your ex has legal custody or the child. What does the existing Court Order say about physical custody? It is extremely difficult to respond with any specifics since your question does not tell us the facts that we need to know.
