Legal Question in Family Law in Missouri

custody

The father of my son and I broke up about a month ago and we have an agreement that we will each have him every other week. It has been working okay unless he gets mad at me for something and then he says he will not let me see my son. i was wondering if we could go to a lawyer and get a letter that states that we both agree to the agreement of every other week, that way if he tries to withhold my son we will have peice of paper that says otherwise

If you are not ready to get divorced, you could get a seperation agreement outlining the terms of your seperation. There will be a specific portion of seperation agreement regarding your child, visitation, and the like. Or, you could go ahead and get divorced. The divorce decree, of course, would cover visitation. Please let me know if you would like to discuss further.

"The father of my son . . . ?" Sounds to me like you had a child without bothering to get married first. If so, the father of your son has absolutely no legal right to any physical custody of the child unless a court has issued a judgment to that effect. In fact, the father of your child should be taken to court and made to pay child support for this child. Consult with an attorney as soon as you possibly can.
