can i get custody of my kids if the mother was under age and the kids are now in foster care?

Are you the legal father of the children? Is there an administrative or judicial determination of paternity? Did you sign an Affidavit of Paternity for each child? Is your name listed as father on the birth certificate of each child? If not, then you may need to file a lawsuit seeking a Court Order determining you to be the legal fatrher. You may also be able to name the Division of Family Services as a Respondent in that lawsuit and seek a Court Order granting you legal and physical custody of the children.
