How do I get custody of my son if his grandparents were granted guardianship of him. His mother was deemed unfit and lives in a mental facility. Do I have to worry about the judge not granting me custody?

You must file a Motion for custody determination or modification. You must then either move the case to the probate court, or have the probate court case moved to your division. This is assuming that you are filing in the same jurisdiction as the guardianship. If this is at all confusing, you should consult directly with a family law attorney in your area. They may want to find out why the grandparents were chosen over you. it could alter your expectations.
