custody of son

i lived in missouri with my husband and i had a child from another relationship. recently i have been divorced and have moved to california. In the divorce papers there was a stipulation which i overlooked giving custody to my husband. I want my son back. what kind of rights does he have since he is not the biological father. His name is on the birth certificate as the father.

he's presumed to be the father. he has the same rights as any bio-father.
