Legal Question in Family Law in Missouri

Custody of a 5 year old

I have a sister that is a Drug addict and an alcholic and has willing give me her daughter so she can seek treatment. What do I need to do to make this legal in case my sister changes her mind about rehab? She has been in 3 different rehabs just in March 2007 alone and keeps getting worse into drugs. This is the second time she has give her daughter to me. The first time was when my neice was 3 month old, she is know 5.

Your sister should at the least sign a special power of attorney which can legally authorize you to take care of the child for up to one year. Your sister would be able to revoke that power of attorney at any time if she chose to do so. If you really believe that it would be in the child's best interest and you are willing to serve, you may file a Petition asking the Court toname you as the child's guardian. This can be a difficult and somewhat expensive process. In any event, I wish you and your niece the very best.
