Legal Question in Family Law in Missouri

My daughter had a child in 1997 by a man. They were not married at the time the child was born and the man was not named as the child's father on the birth certificate. In 2003, she married her child's father. Now she wants to divorce him. Since the child is not "of the marriage" does my daughter have to file a parenting plan?

Your daughter should file a Petition to Determine Paternity and have the child's father named the legal father and ordered to pay child support. This is what shoudl be done FOR THE CHILD, and I am always amazed that unwed mothers so often fail to think about what is best for the child.
