my daughter was originally born out of weddlock i have heard the mother automatically gets custody in divorce unless they say otherwise is this false does the father have rights too

Mothers and fathers both have rights. If at all possible joint legal custody and joint physical custody are considered for the child. Parents should be working for the best interest of the child and work together to make good decisions about the child's welfare, education, religion and other areas of need. They should also try to divide the time with the child.
