Legal Question in Family Law in Missouri

My daughter will be 17 in less than 30 days. She is living with her father who has legal custody. She would like to continue school and live with me, her mother, once she turns 17. The law is somewhat confusing in regards to this in the state of Missouri. Can she move out and live with me once she is 17? Thank You.

No. The Court Order controls custody issues concerning this child until such time as she is emancipated under the law. If you want to change custody, you will need to file a Motion to Modify the existing Court Order.
