Legal Question in Family Law in Missouri
My daughter is two years old and My husband and I are currently trying to move from Missouri to California due to financial issues. Her father and I have never been married and have never gone through the courts to have a child custody agreement. After my daughter was born he got a paternity test that state he is the father but never went though the court system. We are currently working on child support but only because I was on assistance through the state and we have no current custody hearing in progress. I was wondering if I could lose my rights or get into trouble for taking her out of state without his permission or permission from the courts?

If the father and daughter have an ongoing relationship, guy could lose primary custody (and have to start paying support to the father) if you take her out of the State without his permission or giving proper notice. You need to consult directly with a family law attorney in your area. Many offer a free or low cost initial consultation.
Good luck
WITHOUT A CUSTODY ORDER, EACH HAS AN EQUAL RIGHT TO THE CUSTODY AND CAN KEEP THE CHILD FROM THE OTHER. HE CAN ATTEMPT A FEDERAL KIDNAPPING CHARGE ON YOU. FILLE A PATERNITY CASE AND GET A CUSTODY CHILD SUPPORT AND HEALTH INSURANCE ORDER.
