Legal Question in Family Law in Missouri

About four days ago, a friend of mine's husband told her he was not happy in their marriage. He took several items out of their residence that belonged to him (collector's baseball cards). He also named several other items he planned on taking from the residence. He stated he planned on filing for divorce, but did not have the money yet. She now has caught her husband cheating with another woman (actually in bed). She does not want him coming back into the residence to take anything else. She is afraid of him, and thinks if she makes him mad, he will hurt her. He has a drinking problem, and is prone to violence when intoxicated. What can she do? Please help. She is a dear friend and I don't know what to tell her.

Tell your friend to consult with an attorney. She may want to file for an Adult Abuse Order under which she may be able to obtain an Ex Parte Order immediately keeping her husband out of the house and away from her. The husband will have a chance to present his side of the story in court within a couple of weeks, but in most cases the Ex Parte Order is converted into a Full Order of Protection and your friend will have some legal protection in place for up to a year. That Order can also be renewed if necessary. I have handled many of these cases and I may be able to help your friend with this situation. Please feel free to have her call me for a free telephone consultation.
