Dealing with estate with no will or trust

My mother passed away recently. It was unexpected which means she had no will or trusts set up. Now I'm hearing that since she has unpaid bills and was in debt, the government can come in and take what they want. Is this true? Should i be worried that my juvenile brother and I wont get anything that was hers?
