Legal Question in Family Law in Missouri
Deduction's in Child Support Payments
Since our divorce I have had a lot of problems getting my child support payments.
Last week my exhusband took my daughter to Florida. In his child support payment received for the month of July the check was $150.00 less than the ususal amount.
My daughter told me that this was the money her dad gave her to buy souvenirs on vacation.
This is typical of the things he does with the child support.
Should I try collecting this through small claims court. I am getting aggrevated with this. He does not pay through the courts.
Is there a way to have his wages garnished and paid directly to me without going through the court process?
Thank you
Peggy

You can garnish his bank accounts and get a wage assignment on his wages at work. Call me I can help. 314 725-8000

You certainly do not need to go to small claims court. I would suggest that you speak with the appropriate person in the circuit clerk's office in the county where your divorce decree was issued. You may be able to simply fill out a form with all of the information required for a wage assignment without hiring an attorney. However, if you do need an attorney, your attorney should file a Motion for Contempt seeking all of the back child support and whatever other relief you require. The money your ex gave to your daughter is not "child support" it was a gift from him to her. Your court order requires him to pay the child support to you. Good luck.
