Legal Question in Family Law in Missouri

description of joint physical custody

my wife and i are working out the terms of our divorce and i have asked for joint physical custody. it is my understanding that neither of us would be responsible for child support. she argues that point saying that because i make more money a court will force me to pay her child support even though i will have my daughter half the time. can you please clearify this issue for me

Re: description of joint physical custody

If you are going through a divorce you should be represented by legal counsel and you should direct this question to your attorney. No one should try to go through the divorce process without legal counsel especially when there are children involved. Generally speaking, however, your wife is correct that the court will order child support based upon the Supreme Court guidelines which take into consideration your relative incomes together with the fact that the children will be spending half of the time with you. This may in fact leave you with a child support obligation to pay to your ex-wife. If you are not already represented by legal counsel, and if you are located in the eastern half of the state, you may call me for a free telephone consultation at 314-727-2822.
