Divorce/ child custody

My spouse wants a divorce, but can't pay for it, and neither can I. I have full custody of our 5 year old son and I receive child support from the state. I want to retain full, legal, and physical custody of our son, due to my spouse's history of abandonment and frequent drug use. He smokes marijuana and associates with people who do the same. He has a warrant out for his arrest for a traffic violation. He has threatened to take my son away from me several times. I don't feel that he is a positive role model for our son and I don't feel that he can provide him with everything that I provide for him. My question is what can I do to ensure that my son remains in my full custody?

Three words: "Hire an attorney!" Just how important is your son to you? In your question you provide some facts that give the impression that you believe that it would be in your son's best interest for you to have legal and physical custody. But, you claim that you "can't" pay for a divorce. Either you can save the necessary money,you can use a credit card, you can sell some assets you own, or you can borrow the money it will take to hire an attorney and protect your son. If you son is important to you, you can and will find a way. Good luck.
