Legal Question in Family Law in Missouri

In the divorce decree it states, I have to pay alimony until she is employed or remarried, whichever comes first. Can this be modified? She has been living with a man since 2003 and they have been living off of this support.

Your Judgment should also state whether or not the maintenance award is modifiable. If it does not specifically say "non-modifiable", then you can file a Motion to Modify. If you do not already have an attorney and you are in my geographical area, I might be able to offer my services to you for a reasonable fee. I have handled hundreds of Motions to Modify in the thirty-three years that I have been practicing law. Please feel free to give me a call.

Under the facts you provided, it sounds like your decree is probably modifiable. Or, you may be able to petition for a delaratory judgment, that the condition has been met, by your ex's living arrangement. You should consult directly with an attorney, as there may be other facts, that you were not able to provide, that determines your best course of action.

Good luck
