Legal Question in Family Law in Missouri

divorce and pensions

My wife and I are getting a divorce. We both have 457 retirement plan and I also have a pension through work. My wife has a considerable amount more than I, because she started a couple years prior, while I went to school. We were married when we both started our jobs. Am I entitled to part of her 457.

Re: divorce and pensions

If you are represented by legal counsel, you should address this question to your attorney. If you are not represented by legal counsel, you should be. Normally spouses do acquire marital interests in the retirement benefits of the other spouse that are accrued during the marriage. Your attorney could give you specific legal advice on your situation and also assure that you receive everything that you are entitled to in the divorce. Good luck.
