If a person is married in a state where they are not living and they divorce, do they have to divorce in that same state? Or can they divorce in the state in the state they are living?

Re: divorce

A divorce action may be started in the jurisdiction in which the person lives. There may be reasons to move it elsewhere though. Such as the location of major assets or children.

Re: divorce

You may file for divorce in Missouri if you live in Missouri for at least ninety days prior to filing. However, there are other important considerations. Are there any children? Where do they live? Has your spouse lived in Missouri during the marriage? Is there any property in some other state that would need to be divided in a divorce? You should consult with an experienced domestic relations attorney in the area where you live now to share all of the needed information and get advice specific to your facts. Good luck.
