Legal Question in Family Law in Missouri
Divorce and Real Estate Property
My divorce has been final for 5 months. My ex spouse was ordered to refinance the marital home that we shared that I Quit Deeded to him, within 120 days of the divorce. He has failed to do so. I am still responsible for the loan. My question is can I take him back to court for contempt and to force the sale of the real estate? How can I protect myself now, he has aready been late on 3 payments.

Re: Divorce and Real Estate Property
Yes, you can take him back to Court and probably should do so immediately even though this will mean some "up front" expense for you. You can file a Motion for Contempt and combine it with a Motion to determine damages, and possibly wind up with either enforcement of the Order or damages or both. Please consult with your attorney. If you are not represented by legal counsel, you may call me for a consultation.
