I am an over the road truck driver. Husband left this truck Sept 22 and is now in his own lease/purchase truck. How do I go about filing for divorce while on the road? Will he have to sign? I don't know exactly where he is and fear problems from not only him but his family as well. There is a van in both of our names which he is more than welcome to have. All I want is his name off the lease on my truck, he keeps the van and go our own way! There are no children or property.

You will still need to have him served - either personally, by publication through the newspaper, or have him sign an entry of appearance acknowledging receipt of the summons and petition. If the two of you can reach an agreement on the property a settlement agreement can be done and filed with the court. You will need to check with the company that has the lease/purchase agreement on your truck to see what it will take to remove your husband from the agreement. There are times when the company will not allow this. Good luck.
