emancipated

If a child is emancipated, due to over 18 years old and not in school, can that be reversed by going back to school later? Or is that final, pertaining to child support.

Re: emancipated

The child support statute requires the child to enroll full time in college by October first following graduation from high school or obtaining a GED, togerther with several other requirements. There may be a few exceptions, such as cases of disability, but generally, the child does not get to wait and sign up for college later and still be entitled to child support. You may need to file a Motion to Terminate wth the court in order tobe sure that your child support obligation is terminated properly.
