Legal Question in Family Law in Missouri

My ex-husband has agreed that it is in the best interest of our to children that he sign over the rights of his children to my boyfriend and I hoever we are not married at this time. Can he sign over the rights and my boyfriend legally adopt them without us being married.

Technically the law does not prohibit this but it is within the discretion of the court, and most courts are hesitant to do this without some good explanation.
