Legal Question in Family Law in Missouri
Failure to Disclose All of Marital Property
I was divorced in February 2002. In May 2002 I discovered proof that my ex-husband failed to disclose $100,000 of our marital property, which he had told me that he had already spent. I am wondering if I can file an appeal and go back into court to try to get my half of that $100,000???

Re: Failure to Disclose All of Marital Property
Yes, you maybe able to reopen the dissolution of marriage proceedings based upon your ex-husbands hiding $100,000.00 in marital property, but time is of the essence. You may choose to take this up with the attorney who represented you in the divorce, or you are free to hire any legal counsel of your choice. Your divorce attorney may have done nothing improper, or it is possible that he or she did not pursue discovery of assets aggressively enough. If you would like to consult with me about this, I would need to review all of the pleadings from the divorce case and then I would need to carefully analyze the "proof" you have showing that your ex failed to disclose maarital assets. If you are not already represented by legal counsel you may call me for a free telephone consultation at 314-727-2822. If I am able to help you and you desire me to do so, I will quote you a reasonable retainer fee and set up an appointment. Thanks, and good luck!
