Father taking child to get daughter in safe enviroment
Is it legal for me to take my daughter if the living conditions are a hazard to babys health.
My name is on the birth cirtifacte and shes has my last name rather than her mothers.We are not married

You do not mention whether of not you have been legally declared the father of this child or whether you have any Court Ordered rights of visitation or custody. Unless these things have happened, the fact that you believe yourself to be the father or the fact that your name is on the birth certificate do nothing to give you the legal right to remove the child from her mother. If the situation is serious, you could "hot line" the mother and the division of Family Services may step in to protect the child. Otherwise, it would appear that you would need to take legal action to have yourself legally determined to be the father, and also to obtain a Court Order regarding custody.
